1. Agreement to these Terms

These Terms of Service ("Terms") govern your use of Finiin, including the website at finiin.com, the Finiin customer mobile app, the Finiin Driver mobile app, and partner dashboards (together, the "Services").

Finiin is operated by Automation, LLC ("Automation, LLC," "Finiin," "we," "us," or "our"), a Minnesota limited liability company. By creating an account or using Finiin, you agree to these Terms and our Privacy Policy at https://finiin.com/privacy-policy.

If you do not agree, do not use the Services.

2. Who Finiin is for

Finiin is a food ordering and delivery platform that connects customers, restaurant and grocery partners, and delivery drivers.

Customers must be able to enter a valid delivery address and complete payment for orders. Drivers must be at least 18 years old and meet eligibility, document, and screening requirements. Food place partners must provide accurate business information and fulfill orders they accept.

3. Accounts

You are responsible for the accuracy of information you provide and for keeping your login credentials secure. You must promptly update account details when they change.

We may suspend or terminate accounts that violate these Terms, create safety or fraud risk, or are used in a way that harms customers, partners, drivers, or the platform.

4. Orders, payments, and refunds

When you place an order, you authorize payment for the items, fees, tips, taxes, and other amounts shown at checkout. Payments are processed by Stripe. We do not store full payment card numbers on our servers.

Restaurants prepare food after an order is confirmed. Delivery timing is an estimate and may change based on preparation, traffic, weather, and driver availability.

Refunds, credits, and cancellations are handled according to order status, restaurant policies, and our support review. Contact support@finiin.com for order issues.

5. Drivers and food place partners

Drivers and food place partners are independent parties using Finiin tools to fulfill deliveries and orders. Drivers may be required to complete identity verification and background screening (such as through Checkr) before becoming eligible.

Partners and drivers must provide accurate information, follow applicable laws, and use customer data only as needed to fulfill orders or deliveries.

6. SMS and text messaging terms

Finiin may send transactional SMS messages related to your account, orders, and deliveries. This includes messages such as order confirmation, preparation status, driver assignment, pickup, arrival, delays, delivery confirmation, payment or handoff links, and account verification codes.

By providing your mobile number and agreeing to receive SMS (by checking an unchecked consent box in the Finiin app or website during account creation or checkout), you consent to receive these transactional text messages from Finiin.

Message frequency varies based on your orders and account activity. Message and data rates may apply. Consent to receive SMS is not a condition of purchase.

You can opt out at any time by replying STOP to any Finiin text message. After you opt out, you may receive one final confirmation message. Reply HELP for assistance, or contact support@finiin.com / 612-703-9647.

Mobile phone numbers, SMS opt-in data, and SMS consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information may be shared only with service providers, such as Twilio, when necessary to deliver the requested messages and operate the service.

Carriers are not liable for delayed or undelivered messages.

7. Acceptable use

• Do not misuse the Services, attempt unauthorized access, or interfere with platform security or operations.
• Do not place fraudulent orders, abuse promotions, harass other users, or submit false information.
• Do not use Finiin for unlawful purposes or in violation of applicable delivery, food-safety, or transportation rules.

8. Intellectual property

Finiin branding, logos, software, and content are owned by Automation, LLC or its licensors. You may not copy, modify, or distribute our materials without permission, except as needed to use the Services as intended.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted service, exact delivery times, or that restaurants or drivers will always be available.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMATION, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF FINIIN.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO FINIIN FOR THE ORDER OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

11. Indemnification

You agree to indemnify and hold harmless Automation, LLC from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, violation of these Terms, or infringement of another party's rights.

12. Changes

We may update these Terms from time to time. When we do, we will revise the "Last updated" date below. Continued use of Finiin after changes become effective means you accept the updated Terms.
